Description

An Estate Trustee During Litigation (also known as an administrator pendent lite) is appointed by the court to represent the estate when an action respecting the validity of the will of a deceased person, or for obtaining, recalling or revoking any probate or grant of administration. The Estate Trustee During Litigation has all the rights and powers of a general administrator, other than the right to distribute the residue of the property. The role of the Estate Trustee During Litigation is to preserve estate assets, assist the parties in obtaining the documentary and other evidence necessary to resolve the estate dispute and to otherwise fulfill the role that an executor would fill until the litigation is concluded.
